Survey Sampling 2018-2019 Prize Draw

Official Rules


1. Eligibility: Survey Sampling 2018-2019 Prize Draw (the “Promotion”) is open only to legal residents of Australia aged sixteen (16) years of age, or older, who are eligible to participate on the Promoter's Australian OpinionWorld, YourVoice or MyOpinions Panel (each a "Panel" and collectively "Panels"). Employees of Survey Sampling International, LLC, Survey Sampling Australia Pty Ltd., and their respective parent, subsidiary and affiliate companies and suppliers, vendors and agents, as well as their respective family and household members are not eligible to enter. The Promotion is subject to all applicable laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Promoter’s (as defined herein) decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Promotion begins at 00:01 Eastern Standard Time (“AEST”), 1st August 2018, ends at 23:59am AEST, 30 June 2019 (the "Promotion Period"), and consists of four (4) entry periods ("Entry Periods"). The draw will take place at the offices of MDSA located at Level 2, 40 Yeo Street, Neutral Bay, NSW 2089, AUSTRALIA on the dates and time specified below. The winner in each draw will be notified by email and announced on the Panel website corresponding with their entry. So far as practicable, the email notification to the winner will be sent within two days of the draw.

Promoter’s computer is the official time-keeping device for the Promotion.


4. How to Enter:

a. Participate in a Panel. Sponsor collects data from individuals who participate in one of its consumer survey Panels. To participate in the Prize Draw, you must be a member of at least one (1) Panel:

You may already be a member of a Panel or you may register to join a Panel free during the Promotion Period. You do not earn an entry by registering, but you cannot participate in a survey without being a registered member of a Panel.

b. Participate in a Survey. During the Promotion Period, the Sponsor will invite members of the Panels to participate in surveys that solicit the responses and answers to survey questionnaires. When you complete a survey, you receive one (1) entry in the Prize Draw for the Entry Period drawing (as described above in Section 3) associated with the date and time of your participation. If you are unable to complete the survey because you receive a 'screened out' notice or message when attempting to take a survey or a 'quota full' message when attempting to take a survey, you will also receive one (1) entry in the Prize Draw for the Entry Period associated with the date and time of your attempted survey participation.

Entry Restrictions. Each eligible entrant must have his/her own e-mail address, separate from the e-mail address of any other eligible entrant. Any attempt by any entrant to obtain entries by using multiple/different e-mail addresses, identities, registrations and log-ins, or any other method(s), will void all of that participant’s entries and may subject such individual to additional sanctions or penalties in accordance with the applicable Panel terms and conditions. Use of any automated system to participate in the Prize Draw is strictly prohibited and will result in disqualification and all entries submitted or received via such automated system will be void. Neither the Sponsor nor the Administrator are responsible for lost, late, incomplete, invalid, unintelligible or misdirected information or entries, which will be disqualified and void. In the event of a dispute as to the identity of any entrant, the authorized account holder (as defined herein) of the e-mail address used by, or connected to, the eligible entrant will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider, Internet service provider or any other organisation responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorised account holder.


5. Prize Drawings and Verification of Potential Winners:
Winning is contingent upon complying with all terms and conditions of, and fulfilling all requirements contained in, these Official Rules. After each Entry Period, an independent judging organization, will randomly select one (1) winner from all eligible entries received during the applicable Entry Period on the dates set forth in the chart in Section 3. The winner (whether in original the draw or the unclaimed prize draw provided for below) will be notified by email after the date of the drawing and announced on the Panel website corresponding with their entry on the date set forth in the chart in Section 3 for a minimum of 28 days. The email notification will be sent within two (2) business days of the applicable draw. Except where prohibited, the winner will be required to sign and return winner documentation, as determined by the Promoter in its sole discretion, to confirm eligibility, release the Promoter of liability, or for any other reason deemed necessary by the Promoter. Except where the documentation is prohibited, it must be received by the Administrator within the time frame indicated at the time of initial win notification otherwise the winner forfeits the prize. Subject to an unclaimed prize draw clause, if the potential winner cannot be contacted, fails to sign and return the required documentation within the time stipulated by the Promoter, or a prize is returned as undeliverable, the winner forfeits all rights in and/or to the prize. The winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that the winner forfeits the prize or is disqualified for any reason, the Promoter will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. If required, an unclaimed prize draw may take place on three (3) months from the dates of the original drawing as listed in the chart in Section 3 at the same time and place as the original draw, subject to any directions from a given under the legislation regulating the Promotion. Unclaimed prize draw and announcement dates, if required will be as follows;

The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these official rules or who tampers with the entry process. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.


6. Prize:
FOUR (4) PRIZES (1 awarded each Entry Period): The first valid entry drawn each Entry Period will receive a prize consisting of $5,000 AUD. Prize will be awarded by means of cheque or an electronic transfer fund, as directed by Sponsor in its sole discretion. If the person who won is under eighteen (18) years of age, references in this document to the "winner" are references to the parent or guardian of the person who won. Total prize pool value is $20,000 AUD. Prize is non-transferable and no substitution will be made except as provided herein at the Promoter’s sole discretion. The Promoter will not be liable or responsible for any lost, stolen, or misplaced prizes. Winner is responsible for all taxes and fees associated with prize receipt and/or use.


If proposed prize money is greater than $2000 the prize winner must be paid the amount exceeding $2000 by a crossed cheque made out to the winner (or by EFT if the winner so requests). The full prize amount can be paid in this manner, if desired.


7. Release:
By entering the Promotion, each entrant agrees to release and hold harmless Survey Sampling International, LLC, the Promoter, Administrator, MDSA, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize. This Release does not apply to claims for personal injury or death caused by the negligence of the Released Parties.


8. Publicity:
Except where prohibited, participation in the Promotion constitutes winner’s consent to Promoter’s and/or its agents’ use of winner’s name likeness, image and/or voice (incl. photograph, film and/or recording of the same) and country of residence for promotional purposes in any media, worldwide, for an unlimited period of time without further payment or consideration and without notice and/or consent for the purpose of promoting this competition (including any outcome).


9. General Conditions:
Subject to the approval of the authorities that have issued permits for the conduct of the Promotion, the Promoter reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond the Promoter’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by the Promoter in its sole discretion. The Promoter reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. The Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.


10. Limitations of Liability:
Except for any implied condition, guarantee or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void (“Non Excludable Condition”), the Promoter excludes from these Official Rules all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; and/or (e) a prize or use of a prize. No more than the stated number of prizes will be awarded.


11. Jurisdiction:
The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.


12. Entrant's Personal Information:
All personal information will be treated in accordance with the Promoter’s privacy policy:

Where selected as a winner, all personal information will also be treated in accordance with Administrator’s privacy policy: Personal information will be used for the purpose(s) for which it is disclosed, including, without limitation, membership in a Panel; and eligibility for, and communication in connection with, the Promotion. Entrants have the right to access, withdraw, and correct their personal information. In regards to accessing, withdrawing, and/or correcting personal information to be used in connection with the Promotion, entrants may request such action by sending a message to: “Personal Information”, c/o Survey Sampling International, LLC, 6 Research Drive, Shelton, CT 06484, U.S.A., Attn: Legal Department; or

The personal information submitted, received, or collected in connection with the Promotion shall be stored on a server within the United States of America. Entry into the Promotion constitutes your acknowledgement of, and explicit consent to, the export of your personal information to the United States of America and its use there for the purposes of administering this Promotion and associated processing (e.g., but not limited to back-up, archiving).


13. Severability:
If the application of any provision of these Official Rules to any particular facts or circumstances shall for any reason be held to be invalid, illegal or unenforceable by a court, arbitration panel or other tribunal of competent jurisdiction, then (a) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of these Official Rules, shall not in any way be affected or impaired thereby; and (b) such provision shall be enforced to the maximum extent possible. In addition, if any provision contained in these Official Rules shall for any reason be held to be excessively broad as to duration, geographical scope, activity or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with applicable law.
